What is a Class Action?

  • A lawsuit in which the court authorizes a single person or a small group of people to represent the interests of a larger group”(Black’s Law Dictionary 8th ed.)

Why Are Class Actions Useful?

  • “Class Actions are often the only way to hold corporations accountable when they break the law and harm their consumers.” (Gupta, 2010).
  • Class actions are “a device for vindicating claims which, taken individually, are too small to justify legal action but which are of significant size if taken as a group.” Leardi v. Brown, 394 Mass. 151, 164, H. Newberg, Class Actions Section 1010.5(c), 1977.

What is a Class Representative?

  • The terms “Class Representative” and “Named Plaintiff” are interchangeable –  both describe the person whose name is listed on a class action lawsuit. The Class Representative is standing up for a group of people who have suffered the same harm.  

Standing up for What is Right

  • If you have been harmed by a company, think of how many others also have been injured by the same unethical business practice.  At one end of the spectrum, maybe a bad medicine made you seriously ill, or caused a birth defect to your child.  At the other end of the spectrum, maybe you were charged ten cents over the price advertised.  Whatever the case, a business practice that has affected you in a negative way has likely affected many others also.
  • If you are thinking of being a named plaintiff and wondering “what’s in it for me?,” there are both tangible and intangible benefits.  First, and most obviously, without a plaintiff, there can be no class action.  When a person elects to become a class representative in a lawsuit against an unethical corporation, they undertake an important public service.  By bringing to light a harmful business practice, they raise awareness about and inspire others to join them.  In this way, that first courageous named plaintiff gives voice to dozens or even thousands of people who have been wronged.  Therefore, because of the contribution of the named plaintiff, an injustice or series of injustices can be corrected.
  • Corporate wrongdoers often count on no one taking the time and effort to expose them.  For this reason, in many instances, one class representative can make a tremendous difference that benefits a large group of people.
  • Class actions frequently have a ripple effect. They usually send a message to other corporations within an industry to change their practices before they end up in court also.
  • Finally, in instances where our government refuses to crack down on unfair and deceptive business practices, class action lawsuits are sometimes the only way to create change.

Incentive Awards

  • Generally, named plaintiffs receive no more than the other members of the class.  However, sometimes there are court-approved “incentive awards.” According to an excerpt from the National Association of Consumer Advocates, Class Action Guidelines:
  • “Most recent decisions…have approved the incentive award payments to named plaintiffs in recognition of their efforts in achieving the results obtained. Many cases note the obvious public policy reasons for encouraging individuals with small personal stakes to serve as class plaintiffs in meritorious cases….The amounts awarded in reported cases vary widely from token payments to amounts in the tens or—rarely—even hundreds of thousands of dollars. See e.g., Fears v. Wilhelmina Model Agency, Inc., 2005 U.S. Dist. LEXIS 7961, 9-10 (S.D.N.Y. 2005) (approving incentive awards of $25,000 and $15,000; noting cases approving awards as low as $336 and as high as $303, 000  most awards being in the $10,000 to $50,000 range).”
  • The named plaintiff in a TCPA class action against AT&T received an incentive award of $10,000.

What Does a Class Representative Do?

  • A class representative has certain basic obligations, such as staying informed about the case, and remaining in contact with class counsel. In a consumer case, a class representative may have to produce a receipt for his or her purchase, if they still have it.  If the receipt is lost, it need not be produced. In other words, just because a person didn’t keep a receipt for a defective product, it does not mean they cannot serve as a named plaintiff in a class action.
  • The amount of involvement a class representative has in a given case depends on the circumstances.  Most class action settle. Some cases settle before Discovery begins. In rare instances, class actions go all the way to trial. A class representative may never spend more than the time it took to initiate the case- i.e. speaking with a lawyer, answering a few questions, and looking at a Complaint before it is filed. Sometimes, a class representative may sit for a deposition (for which he or she will be well-prepared) and/or give testimony in court.
  • If there is an incentive award, the amount of inconvenience to the plaintiff throughout the case is generally a factor in the Court’s determination of the appropriate amount of the award.

Who Cannot Lead a Class Action

  • Ethical rules forbid lawyers from paying people to become class representatives.
  • A person who purchases a product for the sole purpose of bringing a lawsuit cannot be a class representative.

    I have my mortgage payments to Nationstar since they bought my loan. They claim i owe another $5500. I have produced all receipts as requested. These folks are impossible. I would like a lawyer who specializes in class action as I cannot be the only one with whom these folks are messing.

      I’m also having severe issues with Nationstar Mortgage after being transferred from Bank of America. Telling me we are 8 months delinquent on payments when we are in fact current. They( Nationstar ) is blaming Bank of America….stating they never received all our paperwork….which I faxed along with copies of my cancelled checks for the supposed payments I never made. Requested assistance from my US Senators office. Told my issue was given to the escalation Dept and would be taken care of. Yesterday, received a certified letter stating I needed to pay not just what they say I am delinquent on but $27,000.00 in 35 days or they would begin foreclosure! No one returns phone calls! These people need to be stopped! Over 1,000 complaints on consumer affairs, several hundred on the Better Business Bureau web site…….people need help! I have ALL my documentation showing I am not delinquent! Thinking of contacting the media as well

        Loan servicing complaints against Bank of America and Nationstar Mortgage, LLC
        Section 6 provides borrowers with important consumer protections relating to the servicing of their loans. Under Section 6 of RESPA, borrowers who have a problem with the servicing of their loan (including escrow account questions), should contact their loan servicer in writing, outlining the nature of their complaint. The servicer must acknowledge the complaint in writing within 20 business days of receipt of the complaint. Within 60 business days the servicer must resolve the complaint by correcting the account or giving a statement of the reasons for its position. A borrower may bring a private law suit, or a group of borrowers may bring a class action suit, within three years, against a servicer who fails to comply with Section 6’s provisions. Borrowers may obtain actual damages, as well as additional damages if there is a pattern of noncompliance.

        IN *FEBRUARY 2013 *BANK OF AMERICAN REACHED OUT TO ME TO RESOLVE THIS ISSUE AND I COMPLETE A MAKING HOME AFFORDABLE (REQUEST FOR ASSISTANCE APPLICATION).

        *FEBRUARY 2013-SEPTEMBER 2013(6 MOS) *DURING THE ENTIRE PROCESS DOCUMENTS WERE REPORTEDLY LOSS OR NOT RECEIVED BY *BofA *CUSTOMER SERVICE REPRESENTATIVE, SERVICER INSTRUCTED ME TO MISS PAYMENTS DURING ELIGIBILITY PROCESS, UNRESPONSIVENESS BY SERVICER, REPEATEDLY TOLD THE MY APPLICATION WAS SENT TO UNDERWRITING FOR REVIEW THEN CALLED BACK WEEKS LATER AND REQUESTED UPDATED FINANCIALS, ETC.

I STILL DON’T HAVE TRANSFERRED DEED OF TRUST FROM *BofA/NATIONSTAR MORTGAGE*..

        IN *SEPTEMBER 2013 *I WAS ASSIGNED A *NATIONSTAR MORTGAGE *DEDICATED LOAN SPECIALIST BY THE NAME OF PARIS SMITH. THIS INDIVIDUAL HAS BEEN UNPROFESSIONAL, UNRESPONSIVE, RUDE, NOT RETURNING MY CALLS OR EMAILS. I RECEIVED A DENIAL LETTER STAING I WAS NOT ELIGIBLE FOR HAMP WITH NO EXPLANATION WHY. I WORKED THROUGH THE NORMAL CONTACTS AND CHANNELS WITH NATIONSTAR MORTGAGE. UNFORTUNATELY THIS DID NOT RESOLOVE THE ISSUE AND ELEVATED MY CONCERN TO SENIOR MANAGEMENT BUT RECEIVED A LETTER STATING MS. PARIS SMITH WILL REMAIN MY POINT OF CONTACT-AGAIN NO REASON FOR WHY THEY DENIED MY REQUEST FOR NEW CONTACT PERSON.

        *NOVEMBER 5, 2013 *I RECEIVED A LETTER FROM *NATIONSTAR MORTGAGE *THAT I WAS DENIED A HAMP WITHOUT A EXPLANATION WHY AND TO CALL PARIS SMITH TO DISCUSS OTHER HOUSING/LOAN OPTIONS INCLUDING IN-HOME MODIFICATION. I ATTEMPTED ON MULTIPLE OCCASIONS TO REACH MS. PARIS SMITH TO NO AVAIL.

        ON *NOVEMBER 26, 2013 *I CALLED AND REACHED OUT TO THE *MAKING HOME AFFORDABLE HELP TEAM*(KEN BELL IS MY POINT OF CONTACT) AND REQUESTED TO SPEAK WITH A *NATIONSTAR MANAGER*.

        ON *NOVEMBER 27, 2013 NATIONSTAR *MAILED ME A LETTER STATING THEY WERE UNABLE TO PROVIDE ME WITH A NEW POINT OF CONTACT AND TO CONTINUE WORKING WITH (INCOMPETENT) MS. PARIS SMITH TO DISCUSS HOME MODIFICATION AND OTHER LOAN OPTIONS/ALTERNATIVES.

        ON *DECEMBER 3, 2013 *I CALLED AND SPOKE WITH KEN BELL, MY POINT OF CONTACT WITH MAKING HOME AFFORDABLE HELP TEAM TO EXPRESSED MY DISSATIFICATION WITH NATIONSTAR AND DENYING ME MY REQUEST FOR A NEW POINT OF CONTACT AND NO CALL FROM HER MANAGEMENT TEAM. WE ALSO CALLED NATIONSTAR MORTGAGE AND SPOKE WITH A REPRESENTATIVE. THEY SHARED THAT I WAS DENIED HAMP BECAUSE OF THEIR INABILITY TO LOWER MY MORTGAGE PAYMENTS FROM WHERE IT IS RIGHT NOW WHICH IS AT 2% APR PREVIOUS HAMP WITH BofA FROM 2010.

        ON FRIDAY *DECEMBER 13, 2013 *I LEARNED THAT I WAS ALSO DENIED A *IN-HOME MODIFICATION *BECAUSE I DIDN’T MEET THE “INVESTORS CRITERIA”????? WHEN I CALLED AND SPOKE WITH A *NATIONSTA*R REPRESENTATIVE DURING A CONFERENCE CALL WITH THE HELP OF A HUD-APPROVED HOUSING COUNSELOR THROUGH MONEY MANAGEMENT INTERNATIONAL.. AGAIN, I DID NOT RECEIVE ANYTHING IN WRITING FROM *NATIONSTAR* REGARDING A IN-HOUSE MODIFICATION DENIAL.

    recently my mortgage company gmac transfered my mortgage to green tree , since first month its been imposible to deal with these people , i get 4 calls a day at a minimum about paperwork , moneys , faxes ,, things i dont think i should be harased for , its not my fault they bought my mortgage thats between them and my old financial institution , now my house payment when up 240 dollars more than it used to , heres a special quote from the operator “”””””” well sir , do understand how stores loose because of shoplifting ??? i said no , well because of one shoplifter the company looses so everyone has to be treated the same ,,wich i replied are u calling me a crook??? she said again “””””” everyone gets the same treatment so the company wont keep loosing “”””” so i understood “””” WE ARE ALL CROOKS ??????? ITS THATS HOW IM PORTRAYED TO A COMPANY OR COMPANIES WHOM I PAY FOR SERVICES OUT OF MY HARD EARNED MONEY

    My loan was transferred to Green Tree LLC. From GMAC. These people are awful. I have a very low interest rate and they are constantly increasing my payments. When you call to speak to someone in the office you are harassed and yelled at. I was told at one point to shut and listen. I refuse to treated with disrespect. Something needs to done. This company is out of control.

    I am having a problem with Nationstar and bank of America also, they keep saying I am behind my mortgage is late . They also tried to stop me from getting the mortgage insurance co I wanted . they have their own insurance co who cost more !

    “My mortgage was sold from BOA to Green Tree in October, 2013. My account is current and up to date. Green Tree did not pay my Homeowners Insurance or Wind coverage, one due 1/22/14 & one due 1/23/14. I only knew that an “intent to cancel” was coming by receiving notices from both of these vendors. I promptly sent both insurance companies a check, even overnighting one. I tried very unsuccessfully to discuss this with several customer service reps, who were very unhelpful giving me several “emergency fax numbers” to use to send my “intent to cancel” documents to. The last Green Tree customer service rep was extremely rude to me, treating me like I was lying and even told me that Green Tree would not handle my issue immediately as it takes 10 business days for any response from them. Now I am out $1600 of my own money and Green Tree has my escrow money that I have already paid throughout the year. Even on today’s date, 1/27/14, my insurance agent, who is following up on this for me, states no bank check has come from Green Tree to the vendors. I am constantly receiving advertisement in the mail from them asking if I want to refinance, or if I want “their insurance”-are you kidding me?? After starting to research Green Tree, my issue is common and a ruse because if your insurance company does not receive their payment, Green Tree will conveniently have an insurance policy attached for you-I don’t know this yet, but I believe it could be at exorbitant prices. Something is very fishy”.

    NATIONSTAR——————not posting my payments properly is dis-allowing a bi-weekly payment plan which is my intent.– I pay ahead!!! In Dec 2013 I sent 3 separate pmts (12/3, 12/13, 12/30) of $1500 each–total of $4500. The payment is only 2800. The “system” holds the money and never posts it because it is noted as coming in pieces (partial)- therefore putting me behind schedule. (more than once)! This practice is unfair and a class action suit is eminent. I have paid every other loan off early this way–NO PROBLEM! How can you hold 4500 dollars in pmts and never process it allowed the problem to snowball and affect my credit reports? When I complained, I was advised to pay another company (in bed with Nationstar) $295 and $6 a month fees and then they will post my partial pmts correctly. So I did. This extortion/collusion must be illegal. It gets better, I was in process for my fourth refinance with NATIONSTAR (First 3 attempts they lost docs!) but now they tell me I do not qualify bc they never posted my pmt that they were holding!!! Please help-This is really the only one mark on my credit–I always pay more than necessary and work hard to stay on time!

How do you know if your name came from Greentree and Bank Of America in a Class action Law Suit; because they took money from us a Insurance Company and put on the mortgage and then had us do a modification and kept the money; Bank of America took the money then turned the mortgage over to Greentree; GreenTree then foreclosed on us.

    Citi Bank(One Main) sold my account to Green Tree Finance when they took over my loan I was not notified by either finance company so we make our payment to One Main they said we did not make the payment she when Green Tree took over I was a month behind I had never been a month behind before this My son was helping me at that time making the payments on my house. He lost his job and could not make the payment, I tried to get a modification starting Oct. 2013 and they said that I live in Texas and they got the loan from Citi Bank so they could not modify the loan. I paid the house to current with my tax return and part of my check in Feb. or March of 2014 and tried to get the loan modified again this time they said that I did not make enough money. I had to sale my house, I could not qualify for a modification of my loan I did not get enough income from social security disability, I sold the house for what was owed on it to Green Tree and the taxes owed on the house. I called Green Tree and they faxed the information to me the pay off 42,904.04 so long as paid by 08/06/2014. The title company wired them the money on 07/30/2014, I have all the papers to prove this they have been trying to call me and have sent information to my son’s address saying I owe now is 3,008.07 the loan officer did not post the payment sent to her she said that it was over 400. short. I don’t know about anyone else but the information they sent was 41,005.10+1,820.12+78.82=42,904.04 this the exact amount sent on 07/30/2014. I did upload all there information and the copy of the wire. I told them never call me again or mail me anything except to tell me they have released the lean on the property.

    I have had problems with Nationstar not accepting the loan modification I originally had with Bank of America before B.O.A. sold my loan to Nationstar. In addition to that Nationstar has forced place flood insurance on my property that is a third story condo, not in the flood zone

    Add me I keep getting letters from lawsuit but don’t understand. Green tree totally done me wrong calls paying my land taxes when I don’t have escrow and they wasn’t even due. Sending people to take photos and telling my kids they are taking them due to non payment and soon to be forclosure so they needed a value on house. Sending people to my house all hours even going to my neighbors and telling my business. Threatening me.

    This has been going on for me, since 2012 with Nationstar, but I have come to understand that they have been truly harming many others for much, much longer. When they picked up the servicing from Aurora they found my house, and, put their target on it. I don’t really think that they had any intention to do a single thing other than shoehorn me out of here, and turn my house over. The first time they ever sent a statement was after the foreclosure was already past a default judgement…2014. That includes Aurora! For a loan in 2007! (I’m a widow…) Anyway, I really never found out who owns this “note”. After fighting for this long, from what I can tell, these people have an “F” rating in the BBB in their home state of Texas (where they are Headquartered. They have more complaints than any other servicer for their size, and by the way, the guys who run Nation star are not new to this rodeo. Pun completely intended. .. . But for all their talk, they still hire basically under qualified people for the job, unempowered, or they are just completely understaffed – or a toxic combination of those three. I’ve had telephone calls with several of the first two categories or some combo and the last is the wild card, during the unpleasant and unfortunate circumstances that necessitated my doing so. We have been collectively complaining to all of these agencies for years now. Nothing happens to teflon Nationstar. Why? Why are they always buying more mortgages? It makes me cringe everytime I hear that more people are about to have their lives shattered by this horrific company. Are they ignoring not just our complaints, but our proof? The cancelled checks? the written documentation? What is it? The part I can’t understand is why nobody in any of our regulatory agencies has done ONE THING to stop it. It’s gone WAY TOO FAR. They have gone way too far. Not stopping it is tantamount to endorsing and/or encouraging it. And I hope and pray that our very own government is not even considering giving this putrid group of self congratulating con men any more gse contracts in a market they should be banned for life from.

    Nationstar. I really hope someone starts calling your number next.
